FOLLOW THE EV TERMS AND CONDITIONS

Follow The EV (“we”, “us” or “our”) operates this online store. Our registered office is in Huelva, Spain. These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and any purchases made through it. By accessing or using the Services, or by placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. INFORMATION ABOUT THE SELLER

You must be at least the age of majority in your country of residence to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We may suspend or terminate any account at any time if we reasonably believe these Terms or applicable law have been violated.

3. PRODUCTS AND DESCRIPTIONS

We make every effort to ensure product descriptions and images are accurate. However, colours and appearance may vary depending on your device and settings. Product images are for illustrative purposes only. All products are subject to availability. We reserve the right to modify descriptions, prices, and availability at any time and to limit quantities or refuse orders.

4. ORDERS, ACCEPTANCE AND RIGHT OF WITHDRAWAL

Placing an order constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email and process payment.

Right of Withdrawal (14 days) If you are a consumer in the European Union or United Kingdom, you have the right to withdraw from the contract within 14 calendar days from the day you (or a third party indicated by you) receive the goods, without giving any reason and without penalty (except return shipping costs).

To exercise this right, notify us by email at followev01@gmail.com with a clear statement of your decision. You must return the goods in their original condition and packaging. You are responsible for the cost of returning the goods unless the product is defective or not as described.

Certain products are excluded from the right of withdrawal (e.g. personalised items, sealed goods for hygiene or health reasons once unsealed, digital content once downloaded, etc.). We will inform you of any exclusions before purchase where applicable.

5. LEGAL GUARANTEE

In addition to any commercial warranty, consumers in Spain and the EU benefit from the legal guarantee of conformity. In Spain, this guarantee period is generally three (3) years from delivery for lack of conformity. Please contact us if you believe a product is defective or does not conform to the contract.

6. PRICES, TAXES AND PAYMENT

Prices are shown in Euros and include applicable Spanish VAT (IVA) unless otherwise stated. Prices may change at any time. The price applicable to your order is the price displayed at the time of purchase. You agree to pay all amounts due, including shipping costs and any applicable taxes or duties.

7. SHIPPING AND DELIVERY

Delivery times are estimates only. We are not liable for delays caused by carriers, customs (for deliveries outside the EU), or events beyond our reasonable control. Risk and title pass to you upon delivery of the goods to the carrier.

8. INTELLECTUAL PROPERTY

All content on the Services (text, images, logos, graphics, videos, product descriptions, etc.) is owned by Follow The EV or its licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.

9. USER CONTENT AND FEEDBACK

If you submit reviews, photos, comments, suggestions or any other content (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish and display such Feedback for any purpose, including commercial use. You represent that you have all necessary rights to the Feedback and that it does not violate any third-party rights or these Terms.

10. PROHIBITED USES

You may use the Services only for lawful purposes. You agree not to:

  • Use the Services for any unlawful, fraudulent or malicious purpose;
  • Infringe our or any third party’s intellectual property or other rights;
  • Harass, abuse or harm any person;
  • Transmit spam, malware or harmful code;
  • Use any automated means (robots, scrapers, AI agents or data extraction tools) to access the Services without our prior written consent;
  • Circumvent security measures, CAPTCHAs or access controls;
  • Collect personal data of other users without consent.

We may suspend or terminate your access immediately for any violation.

11. AGENTS (AI, AUTOMATED SYSTEMS AND SCRAPERS)

If you use, deploy or cause any Agent to access or interact with the Services, the following rules apply. “Agent” means any software, script, AI system or automated tool that acts autonomously or semi-autonomously.

No Agent may access the Services unless it:

  • Clearly identifies itself in every HTTP/HTTPS request by including “Agent/[Agent Name]” in the User-Agent string;
  • Does not mimic human behaviour to evade detection;
  • Does not circumvent CAPTCHAs or other anti-bot measures;
  • Responds truthfully when asked whether it is human or automated;
  • Complies with all technical restrictions we impose.

We may block, limit or take legal action against any Agent or user that violates this section.

12. THIRD-PARTY LINKS AND TOOLS

We may provide links to third-party websites or tools. We have no control over and accept no liability for such third-party content, products or services. Your use of them is at your own risk.

13. RELATIONSHIP WITH SHOPIFY

Follow The EV is powered by Shopify. All sales are made directly between you and Follow The EV. Shopify is not responsible for any aspect of your purchases or transactions with us. You expressly release Shopify and its affiliates from all claims arising from your use of the Services or purchases from Follow The EV.

14. PRIVACY AND DATA PROTECTION

Our collection and processing of personal data is governed by our Privacy Policy [LINK], which complies with the General Data Protection Regulation (GDPR) and Spanish data protection law (LOPDGDD). By using the Services, you acknowledge that you have read and understood our Privacy Policy.

15. DISCLAIMER OF WARRANTIES

The Services and products are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, except for the mandatory legal guarantees that apply to consumers under EU and Spanish law (including the legal guarantee of conformity).

16. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Follow The EV, its officers, directors, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits or data.

This limitation does not apply to liability arising from:

  • Gross negligence or wilful misconduct;
  • Death or personal injury caused by our negligence;
  • Defective products under the Spanish Product Liability Law or applicable EU directives;
  • Any other liability that cannot be excluded or limited under mandatory consumer protection law.

Our total liability to you shall not exceed the total amount paid by you for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.

17. INDEMNIFICATION

You agree to indemnify and hold harmless Follow The EV and its affiliates from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or third-party rights, or your use of the Services.

18. FORCE MAJEURE

Neither party shall be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, supply chain disruptions, or carrier failures.

19. ELECTRONIC COMMUNICATIONS

You consent to receive all communications from us electronically. Electronic communications satisfy any legal requirement that they be in writing.

20. DISPUTE RESOLUTION, MEDIATION AND JURISDICTION

These Terms and any dispute arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of Spain.

Any dispute shall be subject to the exclusive jurisdiction of the courts of Huelva, Spain, with express waiver of any other jurisdiction that might otherwise apply.

This clause is without prejudice to any mandatory consumer protection rights you may have under European Union law or the law of your country of residence (including the right to bring proceedings in the courts of your domicile under Regulation (EU) No 1215/2012 – Brussels I bis – where applicable).

21. CHANGES TO THESE TERMS

We may update these Terms at any time by posting the revised version on our website. Material changes will be notified in accordance with applicable law. Your continued use of the Services after changes constitutes acceptance of the updated Terms.

22. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force. These Terms, together with our Privacy Policy and any policies referenced herein, constitute the entire agreement between you and us.
